These Terms of Service ("Terms") govern your use of dspgo.io (the "Site"), operated by Asher Technologies Inc., doing business as DSP GO ("we", "us", or "our"). By using the Site, you agree to these Terms.
These Terms cover the marketing website. Access to and use of the DSP GO platform is governed by a separate agreement between DSP GO and your organization, and use of the platform's applications is addressed in the "Platform Applications" section below.
Use of the Site
You may use the Site for lawful purposes only. You agree not to interfere with the Site's operation, attempt to gain unauthorized access to any systems, scrape or harvest data at scale, or use the Site to transmit malicious code.
Intellectual Property
The Site and its content, including text, graphics, logos, and software, are owned by DSP GO or its licensors and are protected by copyright, trademark, and other laws. You may not reproduce or redistribute Site content without our prior written consent. Amazon and related marks are trademarks of Amazon.com, Inc. or its affiliates; DSP GO is an independent product and is not affiliated with or endorsed by Amazon.
Pricing and Product Information
Pricing, features, and availability described on the Site are provided for general information, may change without notice, and do not constitute a binding offer. Purchases of the DSP GO platform are made under a separate agreement.
Trials, Billing, and Refunds
Unless superseded by a subscription agreement between DSP GO and your organization, the following terms apply to DSP GO subscriptions.
DSP GO subscriptions begin with a free trial of one month with the entire platform included. No payment is taken during the trial. After the trial, you may subscribe on a monthly basis or commit to an annual term; annual commitments are billed monthly across the 12-month term and run for the full term. Monthly and annual seats may be combined on the same account, with each seat billed at the rate of its own term. An annual commitment may be terminated early by paying an early-termination fee of CAD $5.00 per licensed seat for each month remaining in the term, after which no further subscription fees are billed.
Because the first month is free and provides a full opportunity to evaluate the platform, all fees paid are non-refundable, and we do not offer a money-back guarantee, except where a refund is required by applicable law. Monthly subscriptions may be cancelled ahead of any renewal, in which case service continues to the end of the period already paid for.
Platform Applications
The DSP GO platform includes a web portal for organization staff, a careers portal for job applicants, and the DSP GO mobile app for employees. Access to the web portal and the mobile app is provided through your organization, which manages your account, and is subject to that organization's agreement with DSP GO. The careers portal is provided on behalf of the organization you are applying to and presents its own terms of use when you create an account there.
You may use these applications only for their intended purpose in connection with that organization, and you agree not to reverse engineer, copy, or misuse them. Our handling of personal information across the platform is described in our Privacy Policy. Mobile app downloads from the Apple App Store or Google Play are also subject to those stores' terms.
Third-Party Services
The Site integrates third-party services such as demo scheduling and contact form processing, and the platform relies on third-party services such as cloud hosting, push, email, and SMS notification delivery, and electronic document signing. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services we do not control.
Disclaimer
The Site and the platform applications described above are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site or the platform will be uninterrupted or error-free. Where your organization has a subscription agreement with DSP GO, any warranties in that agreement apply to your organization in place of this section.
Limitation of Liability
To the maximum extent permitted by law, DSP GO will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or the platform applications. Our total liability to you in connection with the Site or the platform applications will not exceed one hundred Canadian dollars (CAD $100). This section does not limit any obligations DSP GO owes to your organization under its subscription agreement, and nothing in these Terms excludes liability that cannot be excluded under applicable law.
Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts located in Alberta, Canada.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
